Courts too are to apply data protection rules, even when they publish judicial decisions. Depending on what we attribute to the notion of judicial capacity, Supervisory Authorities may (not) have the competence. Under "we" I mean the national legal system and interpretation thereof. The EPO have released the draft 2023 version of the Guidelines for Examination today (https://lnkd.in/emXf54zS).These new Guidelines will come into force on 1 March 2023. For the uninitiated: I've spent a lot of time in FOIA reading rooms and FOIA logs throughout the last year. The American Public deserves transparency, and with FOIA, the government is failing. Here are some things I've noticed from the civic technology, oversight, and public transparency viewpoints: Agencies purposefully fail to index FOIA reading rooms on search enginesFOIA reading rooms are functionally brokenAgencies purposefully understaff FOIA sections to avoid processing/document productionAgency processing times are intentionally geared towards slow production relative to the statute of limitations for document retention under DOJ guidance (7 years)Congressional oversight authority is lacking “kahunas”#FOIA #civictech
